民政部等七部門(mén)近日聯(lián)合發(fā)布關(guān)于加強(qiáng)養(yǎng)老機(jī)構(gòu)預(yù)收費(fèi)監(jiān)管的指導(dǎo)意見(jiàn)，鼓勵(lì)養(yǎng)老機(jī)構(gòu)采用當(dāng)月收取費(fèi)用的方式，并規(guī)定養(yǎng)老服務(wù)費(fèi)預(yù)收的周期最長(zhǎng)不得超過(guò)12個(gè)月。

A guideline on regulating prepayment for elderly care services has been issued by the Ministry of Civil Affairs and six other departments lately. The guideline encourages providing elderly care services through monthly payment. When prepayment is involved, it says, the maximum prepayment period for elderly service fees should not exceed 12 months.

養(yǎng)老機(jī)構(gòu)預(yù)收費(fèi)是指養(yǎng)老機(jī)構(gòu)提前向老年人或者其代理人收取一定額度費(fèi)用，并承諾在一定時(shí)間內(nèi)，按照服務(wù)協(xié)議約定提供相應(yīng)養(yǎng)老服務(wù)的行為。養(yǎng)老機(jī)構(gòu)預(yù)收的費(fèi)用主要包括養(yǎng)老服務(wù)費(fèi)、押金和會(huì)員費(fèi)。養(yǎng)老服務(wù)費(fèi)是指床位費(fèi)、照料護(hù)理費(fèi)、餐費(fèi)等費(fèi)用；押金是指為老年人就醫(yī)等應(yīng)急需要、償還拖欠費(fèi)用、賠償財(cái)物損失等作擔(dān)保的費(fèi)用；會(huì)員費(fèi)是指養(yǎng)老機(jī)構(gòu)以“會(huì)員卡”“貴賓卡”等形式收取的，用于老年人獲得服務(wù)資格、使用設(shè)施設(shè)備、享受服務(wù)優(yōu)惠等的費(fèi)用。

近年來(lái)，一些養(yǎng)老機(jī)構(gòu)采取預(yù)收費(fèi)方式運(yùn)營(yíng)，一定程度緩解了設(shè)施建設(shè)資金不足等問(wèn)題，紓解了運(yùn)營(yíng)壓力。但是，也有少數(shù)養(yǎng)老機(jī)構(gòu)出現(xiàn)了資金管理使用不規(guī)范，資金鏈斷裂后“退費(fèi)難”“爆雷”“跑路”等問(wèn)題，甚至有的不法分子實(shí)施非法集資、詐騙等犯罪行為，嚴(yán)重?fù)p害老年人合法權(quán)益，擾亂養(yǎng)老服務(wù)市場(chǎng)秩序。

為此，民政部、國(guó)家發(fā)展改革委、公安部、財(cái)政部、中國(guó)人民銀行、市場(chǎng)監(jiān)管總局、金融監(jiān)管總局聯(lián)合發(fā)布關(guān)于加強(qiáng)養(yǎng)老機(jī)構(gòu)預(yù)收費(fèi)監(jiān)管的指導(dǎo)意見(jiàn)，自2024年10月1日起施行，有效期5年。其中提到，主要目標(biāo)是，2025年前，建立健全跨部門(mén)養(yǎng)老機(jī)構(gòu)預(yù)收費(fèi)監(jiān)管工作機(jī)制，協(xié)同監(jiān)管進(jìn)一步優(yōu)化，預(yù)收費(fèi)資金監(jiān)測(cè)預(yù)警、風(fēng)險(xiǎn)隱患排查和違法違規(guī)行為的處置能力有效提升，養(yǎng)老服務(wù)市場(chǎng)更加公平有序，非法集資風(fēng)險(xiǎn)隱患有效減少，老年人對(duì)養(yǎng)老服務(wù)消費(fèi)的滿意度穩(wěn)步提高。
